Who’s Legally Responsible for Pest Infestation?
From a legal point of view, it would in all likelihood be the Landlord’s responsibility to make sure properties are well maintained and habitable.
Whilst there are a number of actions you can ask your tenants to take, to ensure that the property is managed (waste and food) appropriately and not providing an appealing environment for pests.
Rodents, such as mice, rats and squirrels can enter your property where there are gaps around external pipes, broken air bricks or missing roof tiles. As a Landlord, you would be expected to ensure the property is in an appropriate condition to stop these rodents from getting in.
Landlords can receive fines for not addressing their responsibilities and for failing to remedy their rodent infested property. Section 11 of the Landlord and Tenant Act 1985.
What are a Landlord's Responsibilities for Pest Control?
- Sealing up all access points from rodents - you need to protect your property from pests being able to get in and your tenants belongings and wellbeing.
- Regularly perform checks on problem or old pipework, drainage or plumbing - these are most likely to be the weak areas that allows pests to enter your property.
- Ensure there are no pests in the property prior to you taking on a new tenancy.
What are a Tenant’s Responsibilities for Pest Control?
- Pets are a known source of insects such as fleas, alongside caring for their pet, your tenant would also be responsible for eradication of fleas from the property by arranging for a treatment for the pet and a professional pest control treatment.
- Covering up / sealing access to food - leaving food out will attract rodents, in this instance it would be a tenants responsibility to solve.
- Appropriate cleaning will prevent insects from being attracted to the property, if pests appear as a direct result of this, it would be the tenants responsibility to solve.
- Taking the necessary steps and calling in a pest control professional, when discovering bed bugs and pharaoh ants which can’t be treated with amateur pest products.
